LIFETIME WORKMANSHIP

Lifetime Labor Warranty Includes*: Any and all roof leaks caused by defective workmanship that arise from the installation of the roofing system. This Labor Warranty guarantees that the installation was performed in accordance with industry standards and the manufacturer’s specifications. Lifetime Labor Warranty does not include roof leaks caused by the following: (1) Obstruction of proper drainage resulting from debris buildup; (2) Standing water or ponding; (3) Excessive walking on the roof and/or walking on the roof by persons who do so improperly; (4) Improper flashing or sealing of any roof penetrations made after the work done by Contractor has been completed; (5) Any physical damage of any nature to the roofing material; (6) Work done on the roof by persons other than Contractor; (7) Damage to the roofing, property, building, or contents caused by fire, settling, distortions, or other failure of the building, natural causes including floods, lightning, high winds, hail, hurricanes, tornadoes, earthquakes, or extraordinary or unusual vents; (8) Damage to the roofing job from cracks or openings in the roof substrate, walls, partitions, foundations, etc.; (9) Vandalism, penetration, damage, or attacks to the roof by third parties or foreign objects or agents including plants or animal life; (10) Damage caused by alteration or addition to encroachment upon erection of a structure on the roof or any use of the roof other than its original intended purpose, including but not limited to, snow shoveling, heat cables, salt, etc. Changes in the use of this building shall be subject to warrantors’ approval in writing; (11) No modifications of this warranty shall be effective unless in writing and approved by all parties; (12) This warranty contains the sole and exclusive liability of warrantor (The Roof Resource) for the labor of the roofing job, the application, maintenance, and repair thereof; (13) This warranty shall not be effective unless executed by an authorized representative of the warrantor (The Roof Resource); (14) This warranty is not intended as a substitute for common sense maintenance program by the owner, nor is it an effective instrument in the face of abuse of the roof by foot traffic and abuse from other trades or individuals. See description of Lifetime Labor Warranty above; (15) Limitation of Liability: The contractor’s liability under this warranty is limited to the repair or replacement of the defective workmanship. The warrantor (The Roof Resource) is not liable for any other damages, whether direct or indirect; (16) Defective workmanship shall be defined as poor workmanship that can render a structure unsafe or unsuitable for the purpose for which it was intended.

Warranty coverage for labor defects shall be defined as a forty (40) year term, which shall be interpreted as lifetime unless otherwise stated in your contract. Payment as per the terms of the contract shall constitute the sole consideration for this warranty. If the owner shall fail to make payment in accordance with the terms of the contract, this warranty shall be null in void and have no further effect.

THIS LABOR WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES WRITTEN, ORAL, EXPRESSED OR IMPLIED INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PRACTICAL PURPOSE.

Certificate of Completion and Satisfaction

The Contractor certifies that as of this listed date, the project is complete and in accordance with the plans and specifications agreed upon by both parties (homeowner and contractor) from the original Roof Resource Proposal. By signing this certificate of completion, the homeowner agrees that all requested and approved work is complete to their satisfaction and there is no outstanding work to be done. This will allow The Roof Resource to register the homeowner’s manufacturer’s warranty and Lifetime Labor Warranty. In the event that this is an insurance claim, this Certificate of Completion and Satisfaction does not waive the insurance company or the insured of any responsibility for funds that may still be due.
